Terms of Service

These terms govern your use of ZidPay. We wrote them to be clear and fair — please read them, they apply to you.

Acceptance

By using ZidPay, you accept these terms of service. If you do not agree with them, do not use the service.

The service is provided by Fortéch Solutions, a company based in Fès, Morocco. When you accept these terms on behalf of a business, you confirm that you have the authority to do so.

The service

ZidPay is restaurant-management software: a cloud platform, an offline-first Hub, and apps that run the floor, the kitchen, the stock, the cash, the staff and delivery.

We improve the product regularly. Some features depend on your subscription plan.

Accounts and license

We grant you a non-exclusive, non-transferable license to use ZidPay for the needs of your venue.

You are responsible for your account, the access you grant your staff, and the accuracy of the data you enter. Keep your credentials confidential — any activity carried out from your account is deemed to be yours.

Subscriptions and billing

Our subscription plans are as follows:

  • Starter: 199 MAD per month.
  • Pro: 499 MAD per month.
  • Enterprise: on quote.

Billing is monthly and per venue. The Pro plan includes a 14-day free trial. Applicable taxes are added in accordance with Moroccan law.

Acceptable use

You agree to use ZidPay lawfully. In particular, you must not:

  • Reverse engineer, decompile, or attempt to extract the source code of the service.
  • Resell, rent, or redistribute the service to third parties.
  • Misuse the service, disrupt its operation, or compromise its security.

Your data

You retain ownership of your restaurant’s operational data. We process it only to provide the service to you.

How we process and protect your data is detailed in our Privacy Policy, which forms an integral part of these terms.

Availability

ZidPay is offline-first by design: your venue keeps running even when the cloud connection is interrupted.

We aim for high availability of the cloud service, but we do not guarantee uninterrupted or error-free operation. Maintenance, incidents, or factors beyond our control may occur.

Liability

The service is provided “as is”. To the extent permitted by law, our total liability is limited to the amount you paid us during the previous three months.

We are not liable for indirect or consequential damages (loss of business, loss of data beyond our fault, lost profits). Your statutory consumer rights under Law 31-08 are not affected by this clause.

Electronic exchanges

You agree that electronic records, communications, and documents exchanged through the service have evidential value.

These electronic exchanges are valid in accordance with Moroccan Law No. 53-05 on the electronic exchange of legal data.

Changes

We may update these terms to reflect changes to the service or to the law. In the event of a material change, we will notify you within a reasonable time.

Your continued use of the service after the new terms take effect constitutes acceptance of them.

Governing law

These terms are governed by Moroccan law.

Any dispute relating to their interpretation or performance falls under the jurisdiction of the competent courts of Fès.
